The Possible Future CEN Standard On Reporting To Regulators For Online Gambling

On November 22nd, the meeting of the possible future Technical Committee ‘Reporting in support of online gambling supervision’ of the European Committee for Standardisation CEN took place in Paris. The meeting was foreseen to be a kick-off meeting for the newly created Technical Committee labeled TC456. However as the formal request for standardisation from the European Commission had not yet been adopted at the time of the meeting, decisions taken at the meeting are at the moment of a temporary nature. If the European Commission sends the formal request, the TC456 will validate the decisions taken in November at a future meeting, foreseen to take place in Brussels. EL Secretary General Arjan van ’t Veer represented EL at the meeting.

In  2012, the European Commission announced a desire to develop a standard for online gambling. In the past two years the plans have became more concrete with the drafting of a potential request to CEN on a list of criteria for reporting to the regulators for online gambling. Following a long consultation with stakeholders, in which EL also participated, a draft standardisation request was published for comments by the European Commission in the spring of 2017http://ec.europa.eu/DocsRoom/documents/22884

The European Commission notes here that the potential future standard is to “determine core data for reporting purposes that could be common across the Member States.”

It is important to stress that any future standard will be voluntary for Member States and their regulators to adopt.

The national standardisation bodies have appointed French standardisation body AFNOR to lead the work and provide the Secretariat to the future Technical Committee on reporting on online gambling which is created specifically for that purpose. There has been no technical committee at CEN-level on gambling to date.

At the time of the writing of this article, the standardisation request as drafted by the European Commission administration has not been adopted at the political level by the College of Commissioners. Standardisation experts note that this is an unprecedented situation.

The discussion at the European level inside CEN is followed in parallel by ‘mirror national technical committees’ in the individual countries, always hosted by the national standardisation body of that country. The national mirror technical committees also send delegates to the European-level discussions within CEN. EL members can participate in the discussions at national level within the mirror technical committee of their country. Many EL members have participated in the discussions moderated by their national standardisation body during the preparation phase of the request.

Claire Pinson, Head of European and International Affairs of the French regulator for online gambling ARJEL was appointed as the Chair of the work of the potential Technical Committee.

The CEN-procedure allows for the representation of stakeholder associations as Liaison Organisations to CEN. EL is one of the stakeholder associations that participate in the meetings as a Liaison Organisation, as are the EGBA (European Gaming and Betting Association, an association of commercial gambling operators) and the Gaming Standards Alliance, GSA Europe.

It is currently uncertain when and if the European Commission will adopt the formal standardisation request and thereby give a mandate to CEN to develop a standard. The continuation of the discussions in the Technical Committee depend on such a decision.

El 22 de noviembre, tuvo lugar en París la reunión del potencial futuro Comité de “Información en apoyo de la supervisión del juego en línea” del Comité Europeo de Normalización (CEN). Se preveía que dicha reunión supusiera la puesta en marcha del nuevo Comité, denominado TC456. Sin embargo, dado que la petición formal de normalización de la Comisión Europea todavía no había sido adoptada en el momento de la reunión, las decisiones que se tomaron en dicho encuentro son, por el momento, temporales. Si se recibe la petición, el TC456 validará las decisiones tomadas en noviembre en la próxima reunión, que se prevé que tenga lugar en Bruselas. EL contó con la representación del secretario general Arjan van ‘t Veer.

Potentieller CEN-Standard für behördliche Berichterstattung zu Online-Glücksspiel

Am 22. November tagte in Paris „Berichterstattung zur Überwachung von Online-Glücksspiel“, ein mögliches künftiges Komitee des europäischen Komitees für Standardisierung CEN. Die Sitzung war als Initialsitzung für das neu ins Leben gerufene Komitee mit der Bezeichnung TC456 geplant. Da jedoch die formelle Anfrage auf Standardisierung von der europäischen Kommission zum Tagungszeitpunkt noch nicht umgesetzt worden war, sind die dort getroffenen Entscheidungen derzeit vorläufiger Natur. Nach Eingang der Anfrage wird TC456 die im November getroffenen Entscheidungen bei seiner nächsten Sitzung, die für Brüssel geplant ist, bestätigen. EL wurde von Generalsekretär Arjan van ‘t Veer vertreten.
